We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies.

Where possible, We apply shorter retention periods and/or reduce identifiability by deleting, aggregating, or anonymizing data. Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. This means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.

Where required by applicable law, We will ensure that international transfers of Your Personal Data are subject to appropriate safeguards and, where relevant, supplementary measures. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of Your data and other personal information.

Law Enforcement

Under certain circumstances, the Company may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other Legal Requirements

Children’s and Minors’ Privacy

The Service is not directed to, and We do not knowingly collect Personal Information from, anyone under the age of 16.

If We become aware that We have collected Personal Information from anyone under the age of 16, We will take steps to remove that information from Our servers as soon as reasonably possible.

Some countries and states set a higher age at which an individual can consent to the processing of their own Personal Information. Where We rely on consent as a legal basis and the law applicable to a User sets an age higher than 16, We may require the consent of that User’s parent or guardian before We collect and use their Personal Information.

Additional Information for Residents of Quebec (Law 25)

This section applies to Users located in Quebec and supplements the rest of this Privacy Policy in accordance with the Act respecting the protection of personal information in the private sector (CQLR c. P-39.1), as amended by the Act to modernize legislative provisions as regards the protection of personal information (“Law 25”). If there is any inconsistency between this section and the rest of this Privacy Policy, this section prevails for Users in Quebec. Where this Privacy Policy is also made available in French, the French version prevails for Users in Quebec.

Q1. Person in Charge of the Protection of Personal Information

The Company has designated a person in charge of the protection of personal information (the “Privacy Officer”). The Privacy Officer is responsible for ensuring that this Privacy Policy and Our internal governance practices are implemented and complied with, for handling Your requests to exercise Your privacy rights, for receiving complaints, and for managing confidentiality incidents.

  • Name: La Taverne Feuille D’Or inc.
  • Title: Privacy Officer
  • Email: tavernefeuilledor@gmail.com
  • Mailing address: 1494 rue Ontario est, Montreal, QC H2L 1S5

Q2. Information Provided at the Time of Collection

Whenever We collect Personal Data from You, We inform You, at or before the time of collection, of: the purposes for which the information is collected; the means by which it is collected; Your rights of access and rectification; Your right to withdraw Your consent; where applicable, the names or categories of third parties to whom the information may be communicated; and the possibility that the information may be communicated outside Quebec.

Upon request, We will also inform You of the Personal Data collected from You, the categories of persons within the Company who have access to it, the retention period applicable to it, and the contact information of Our Privacy Officer.

We collect only the Personal Data that is necessary for the purposes We have identified.

Q3. Consent

Where We rely on Your consent to collect, use or communicate Your Personal Data, that consent must be clear, free and informed, and given for specific purposes. We request consent for each specific purpose, in clear and simple language, and separately from any other information provided to You. Consent is valid only for the time necessary to achieve the purposes for which it was requested.

Where Your Personal Data is sensitive (for example, medical, biometric or otherwise intimate information, or information that gives rise to a high level of reasonable expectation of privacy), We obtain Your express consent before using or communicating it. We do not ordinarily collect sensitive Personal Data through the Service.

We use Your Personal Data for marketing purposes, including the email marketing and text messages described elsewhere in this Privacy Policy, only with Your consent, and in compliance with Canada’s Anti-Spam Legislation.

Where We wish to use Your Personal Data for a new purpose that is not compatible with the purposes for which it was collected, We will obtain Your consent before doing so, unless the law permits otherwise (for example, use for a purpose that is clearly for Your benefit, or in de-identified form for study, research or statistical purposes).

Withdrawal of consent. You may withdraw Your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting Our Privacy Officer or by using the tools provided in the Service (for example, the cookie preferences tool or the unsubscribe link in Our emails). We will inform You of the consequences of withdrawing Your consent, which may include being unable to provide certain parts of the Service.

Q4. Technology That Identifies, Locates or Profiles You

Notwithstanding the “Tracking Technologies and Cookies” section above, any technology on Our Service that allows You to be identified, located or profiled (for example, analytics, advertising or tracking Cookies and web beacons) is deactivated by default for Users in Quebec. We inform You of the use of such technology and of the means available to activate it, and We activate it only if You expressly choose to do so, for example through Our cookie preferences tool. “Profiling” means the collection and use of Personal Data to assess certain characteristics of a natural person, in particular for the purpose of analyzing that person’s work performance, economic situation, health, personal preferences, interests or behaviour.

Q5. Automated Decision-Making

We do not currently use Your Personal Data to make decisions about You based exclusively on automated processing. If We do so in the future, We will inform You at or before the time of the decision and, on request, We will inform You of the Personal Data used to make the decision, the reasons and principal factors and parameters that led to the decision, and Your right to have the Personal Data corrected. You will also be given the opportunity to submit observations to a member of Our staff who can review the decision.

Q6. Service Providers, Affiliates and Business Transactions

When We entrust Personal Data to a Service Provider, We do so under a written agreement that sets out the measures the Service Provider must take to protect the confidentiality of the information, requires the information to be used only for the purposes of the mandate, prohibits the Service Provider from retaining the information after the mandate ends, and requires the Service Provider to notify Us without delay of any confidentiality incident.

In the context of a merger, acquisition, financing or asset sale, We may communicate Personal Data to the other party without Your consent only where necessary to conclude the transaction and under a written agreement under which the other party undertakes to use the information only for concluding the transaction, not to communicate it without Your consent (unless authorized by law), to take the measures required to protect its confidentiality, and to destroy it if the transaction does not proceed or if the information is no longer necessary for the purposes of the transaction. If the transaction is concluded, the other party may use or communicate the information only in accordance with the law, and You will be notified within a reasonable time that it now holds Your Personal Data.

We do not sell Your Personal Data.

Q7. Communication of Personal Data Outside Quebec

Your Personal Data may be communicated outside Quebec and outside Canada. In particular, Our email marketing Service Provider, Hostinger Reach (Hostinger International Ltd, a company incorporated in Cyprus), is located outside Canada, and the Personal Data it processes (such as Your email address and email engagement data) may be stored and processed in Cyprus, Lithuania, the Netherlands or the United Kingdom. That Personal Data is therefore communicated outside Quebec.

Before communicating Personal Data outside Quebec, We conduct a privacy impact assessment that takes into account the sensitivity of the information, the purposes for which it is to be used, the protection measures that would apply to it, and the legal framework of the jurisdiction in which it would be communicated. We communicate Personal Data outside Quebec only if the assessment establishes that the information would receive adequate protection in accordance with generally accepted privacy principles, and only under a written agreement that takes into account the results of the assessment and, where applicable, the terms agreed on to mitigate the risks identified.

Q8. Retention, Destruction and Anonymization

In addition to the retention periods set out in the “Retention of Your Personal Data” section above:

  • Records of access, rectification, portability, withdrawal and complaint requests are retained for up to 24 months from the closure of the request, to demonstrate compliance.
  • Records of confidentiality incidents are retained for at least 5 years from the date We become aware of the incident, as required by Quebec law.

When the purposes for which Personal Data was collected or used have been achieved, We destroy it or anonymize it to use it for serious and legitimate purposes, subject to any applicable legal retention period. Anonymized data is data that irreversibly no longer allows You to be identified, directly or indirectly, in accordance with generally accepted best practices and the criteria and terms prescribed by Quebec regulation.

Q9. Security, Privacy Impact Assessments and Privacy by Default

We take reasonable security measures, having regard to the sensitivity of the information, the purposes for which it is used, its quantity, its distribution and its medium, to protect Your Personal Data against loss, theft, and unauthorized access, use, communication, copying or modification. Access to Personal Data is limited to those members of Our staff who need it to perform their duties.

We conduct a privacy impact assessment for any project to acquire, develop or overhaul an information system or electronic service delivery system involving the collection, use, communication, retention or destruction of Personal Data, and We design such systems so that, by default, the parameters provide the highest level of confidentiality without any intervention on Your part, except in the case of privacy settings for Cookies.

Q10. Confidentiality Incidents

A confidentiality incident means any access to, use or communication of Personal Data not authorized by law, any loss of Personal Data, or any other breach of the protection of Personal Data. If We have cause to believe that a confidentiality incident involving Your Personal Data has occurred, We will take reasonable measures to reduce the risk of injury and to prevent new incidents of the same nature. Where the incident presents a risk of serious injury to You, We will promptly notify the Commission d’accès à l’information du Québec and You, unless doing so could hamper an investigation by a person or body responsible by law for the prevention, detection or repression of crime or statutory offences. We may also notify any person or body that could reduce the risk of injury.

We keep a register of all confidentiality incidents, a copy of which is sent to the Commission on request.

Q11. Your Rights

You may exercise any of the following rights by contacting Our Privacy Officer in writing using the contact information in Q1.

  • Right of access: You have the right to be informed of the existence of Personal Data concerning You that We hold, and to obtain access to it and a copy of it. Where You so request, We will provide the information in writing and, where the information is computerized, in a structured, commonly used technological format.
  • Right to rectification: You have the right to request that inaccurate, incomplete or equivocal Personal Data be corrected, and that Personal Data whose collection was not authorized by law be deleted. Where a request is granted, We will inform any person to whom the information was communicated in the preceding six months and, where applicable, the person from whom We obtained it.
  • Right to data portability: You have the right to request that computerized Personal Data collected from You be communicated to You, or to a person or body authorized by law to collect it, in a structured, commonly used technological format, unless doing so raises serious practical difficulties.
  • Right to withdraw consent: As described in Q3.
  • Right to de-indexation and cessation of dissemination: You have the right to request that We cease disseminating Your Personal Data, or de-index or re-index any hyperlink attached to Your name that provides access to the information by technological means, where the dissemination contravenes the law or a court order, or where it causes You serious injury in relation to Your right to the respect of Your reputation or privacy that clearly outweighs the public interest in knowing the information and the freedom of expression.
  • Right to be informed of automated decisions: As described in Q5.
  • Right to be informed of communication outside Quebec: As described in Q7.
  • Right to file a complaint: As described in Q12.

Verification of identity. Before responding to a request, We may ask You for information reasonably necessary to confirm Your identity.

Response time. We will respond to Your request promptly and no later than 30 days after receiving it. If We refuse Your request in whole or in part, We will inform You in writing, give the reasons for the refusal and the provision of the law on which it is based, and inform You of Your right to have the decision reviewed by the Commission d’accès à l’information du Québec and of the time limit for doing so. A failure to respond within 30 days is deemed a refusal.

Fees. Access to Your Personal Data is free of charge. We may charge a reasonable fee for transcribing, reproducing or transmitting the information, in which case We will inform You of the approximate amount in advance.

Q12. Complaints

If You have a concern about how We handle Your Personal Data, You may submit a complaint in writing to Our Privacy Officer. We will acknowledge receipt of Your complaint, examine it diligently and impartially, and respond to You in writing within 30 days of receipt, explaining the outcome and any corrective measures taken. We keep a record of all complaints received.

If You are not satisfied with Our response, or at any time, You may file a complaint with:

Q13. Minors

We do not collect Personal Information from a minor under 14 years of age without the consent of the person having parental authority or the tutor, unless collecting the information is clearly for the minor’s benefit. For minors aged 14 or over, consent may be given by the minor, by the person having parental authority or by the tutor. If We become aware that We have collected Personal Information from a minor under 14 without the required consent, We will take steps to remove that information from Our servers as soon as reasonably possible.

Q14. Changes Requiring Consent

Where a change to this Privacy Policy would require Your consent under Quebec law (for example, a new purpose for using Your Personal Data), We will obtain that consent before the change applies to You.
